Can anyone explain to me how/why games do not have the same kind of copyright protection as commercial software. providing backups of commercial applications is illegal in international law, but providing backups of games to someone who owns a copy already is not. why so?

The games are usually protected hardware wise where PC apps couldn't because no two computers are the same really.
