I want to do a copy of Empire Earth but it has got a cd check. Is there any way of burning a copy so the game recognizes it as the original? If not, is there a way to read the image and replace the .exe with a no-cd .exe and then burn it to disc?

From what I remember it is protected with Securom, so just read and write the subchannel data and don't play it in a CDRW drive unless you have something like Clone CD's hide CDR function enabled.
You might want to varify the protecion used though.

I copied it no worries but it has got cd check and asks for the original disc when you go to play it.

If it won't load, then you have not "copied it no worries". If your burner does not support RAW DAO or you do not have a drive that can read subchannel data, then you will have to used a cracked EXE.

My burner does support RAW DAO and does read the subchannel data. So clonecd should do a full working backup?
